Terms & Conditions of Sale
Last updated October 15, 2026
1. Acceptance and legal compliance
By placing an order with Osage County Guns ("OCG", "we", "us") online, by phone or in store, you agree to these Terms & Conditions. We may update these terms at any time. The version posted when you place your order applies to that order.
You are solely responsible for knowing and following all federal, state and local laws on buying, owning, transferring, transporting and using firearms, ammunition, magazines, suppressors and related items where you live and where the item will be delivered. Laws change often and vary by city and county. The restrictions listed in these terms are a guide only, not legal advice, and not a complete list.
If we learn that an order is illegal for you to buy or receive, we will cancel it and charge a 5% restocking fee. We may refuse or cancel any order at our discretion, including orders we believe may break the law.
2. Firearm purchases and FFL transfers
We ship firearms only to holders of a valid Federal Firearms License (FFL). You must arrange the transfer with your FFL before ordering, confirm they will accept the shipment, and pay any transfer fee they charge. You can also pick up firearms at our store after completing ATF Form 4473 and a background check.
By ordering a firearm, you certify that:
- You are not prohibited by federal, state or local law from receiving or owning the firearm.
- For handguns, frames, receivers, stripped lowers and other non-long-gun firearms, you are at least 21 and a resident of the state where the FFL is located.
- For rifles and shotguns, you are at least 18 (or older where required) and the transfer is legal in the FFL's state and your state of residence.
- You will complete all paperwork, waiting periods, permits and background checks your state requires.
Active-duty military stationed outside their home state may buy firearms in their duty state. Your FFL may ask for official orders and proof of residence.
If your FFL refuses the shipment, does not receive it, or the transfer is denied or delayed (including a NICS denial or a state permit problem), you are responsible for all return shipping and FFL fees. Refunds on returned firearms are reduced by the 5% restocking fee and the original and return shipping costs.
3. NFA items (suppressors, SBRs, SBSs)
NFA items are sold only to buyers who can legally own them in their state and city. NFA items are transferred only to an FFL/SOT dealer or picked up at our store after ATF approval. You are responsible for any ATF tax, fingerprints, photos and paperwork.
Once we submit the ATF Form 3 to transfer an NFA item to your dealer, cancelling the order costs 20% of the purchase price. ATF wait times are outside our control and are not grounds for a refund. NFA items are final sale and cannot be returned once transferred to you.
4. Magazine restrictions
We will not ship magazines over a jurisdiction's capacity limit to that jurisdiction, alone or packed with a firearm. When a firearm normally ships with standard-capacity magazines, we may remove them before shipping to a restricted state. We do not swap in compliant magazines and do not issue refunds for removed magazines. You are responsible for knowing the limit where you live.
The following jurisdictions currently restrict magazine capacity. This list is a guide only and may not be complete:
| Jurisdiction | Maximum rounds |
|---|---|
| California | 10 |
| Colorado | 15 |
| Connecticut | 10 |
| Delaware | 17 |
| District of Columbia | 10 |
| Hawaii | 10 (handgun magazines) |
| Illinois | 10 long gun / 15 handgun (statewide, plus stricter local ordinances) |
| Maryland | 10 |
| Massachusetts | 10 |
| New Jersey | 10 |
| New York | 10 |
| Oregon | 10 (subject to ongoing litigation) |
| Rhode Island | 10 |
| Vermont | 10 long gun / 15 handgun |
| Washington | 10 |
Some cities and counties in other states also restrict magazine capacity. If an order includes a magazine that is illegal where you live, we will cancel that order or that item.
5. Ammunition
By ordering ammunition, you certify that:
- You are at least 21 for handgun ammunition, or 18 for rifle and shotgun ammunition.
- You are not prohibited by law from buying or possessing ammunition. This includes having no felony conviction, no domestic-violence misdemeanor conviction, no disqualifying protective order, no involuntary commitment and no unlawful drug use.
- The purchase is legal where you live and where it will be delivered.
- You will not resell or give the ammunition to anyone who cannot legally possess it.
Ammunition cannot ship to P.O. boxes. Loaded ammunition is final sale. Special shipping and age rules apply:
| Jurisdiction | Rule |
|---|---|
| Alaska, Hawaii | Ships only by freight forwarder (no ground service) |
| California | Ships only to a licensed California ammunition vendor or FFL for pickup and background check |
| Connecticut | Buyer must hold a valid CT pistol permit, eligibility certificate or ammunition certificate |
| District of Columbia | No ammunition sales |
| Illinois | Valid FOID card required; ships only to the address on the FOID or state ID |
| Massachusetts | No ammunition sales |
| New Jersey | Valid Firearms Purchaser ID or permit required for handgun ammunition |
| New York | Ships only to a licensed NY dealer for pickup and background check |
Cities and counties may have their own restrictions. Orders that cannot legally be completed will be canceled with the 5% restocking fee.
6. Orders, payment and pricing
Payment is charged when you place your order. An order confirmation is not acceptance. We accept your order when it ships or is ready for pickup.
We try to describe and price items accurately, but errors happen. If an item is listed with the wrong price, description, specification or availability, we may cancel the order and refund your payment in full, even after you have been charged. Prices and availability can change without notice.
Product photos are for general identification only. They may show accessories or options that are not included, and manufacturers sometimes change products without notice. The written description controls.
Orders cannot be changed after they are placed. To change an order, cancel it under Section 7 and place a new one.
7. Cancellations
You may cancel an order before it ships by calling customer service during business hours (see Contact). Cancellations carry a 3% fee to cover card processing fees that are not returned to us. A canceled order cannot be reinstated.
Once an order ships, it cannot be canceled. It is handled as a return under Section 8, and you pay the return shipping.
| Order type | Cancellation terms |
|---|---|
| Standard order, before shipping | 3% fee |
| Order illegal in buyer's jurisdiction | Canceled by OCG, 5% fee |
| NFA item after the ATF Form 3 is submitted | 20% fee |
| Custom, engraved or special-order items | Cannot be canceled |
| Program or discount pricing (e.g., law enforcement or military programs) where the buyer does not qualify | Canceled by OCG, 5% fee |
8. Returns
Final sale — no returns or exchanges:
- Firearms, including frames, receivers and lowers, once transferred to you or your FFL
- NFA items
- Optics: scopes, red dots, magnifiers, night vision and thermal
- Loaded ammunition
- Clothing
- Custom, engraved and special-order items
If a final-sale item is defective, contact the manufacturer under its warranty. We are happy to help you start a warranty claim.
All other items may be returned within 14 days of delivery or pickup if all of the following apply:
- You contact us first and receive a Return Authorization (RA) number.
- The RA number is included in the package.
- The item is unused and in its original condition and packaging, with all parts and paperwork.
- You pay return shipping (unless we shipped the wrong item or it arrived damaged).
Returns without an RA number will be sent back at your expense. Returns may be charged a restocking fee of up to 25% of the item price. Refunds go back to the original payment method or, at your choice, to OCG store credit (eWallet). Original shipping charges are not refunded.
Report items damaged in shipping within 48 hours of delivery, with photos of the item and the packaging.
9. Shipping, signature and pickup
In-stock orders usually ship within 2–3 business days. Shipping costs are shown at checkout before you pay. Ship dates are estimates, and we are not responsible for carrier delays.
Firearms always ship with adult signature required. Accessory orders over $200 ship with signature confirmation. You may waive signature confirmation by leaving a note at checkout. If you waive it, you accept all risk of loss once the carrier marks the package delivered, including delivery to the wrong address.
Risk of loss passes to you (or your FFL) when the carrier delivers the package. If a package is marked delivered but you did not receive it, contact us within 48 hours so we can help file a carrier claim.
In-store pickup: choose in-store pickup at checkout. Firearm pickups require a valid government photo ID, ATF Form 4473 and an approved background check. Orders not picked up within 30 days of our pickup notice may be canceled and refunded minus the 3% cancellation fee.
10. Warranty, liability and general terms
Warranty. Products carry only the manufacturer's warranty. OCG makes no other warranties, express or implied, including merchantability or fitness for a particular purpose, to the extent allowed by law.
Limitation of liability. OCG's liability for any order is limited to the amount you paid for that order. We are not liable for indirect, incidental or consequential damages. We are not liable for injury, damage or loss caused by the misuse, modification, improper installation or unlawful use of any product. You agree to indemnify OCG against claims arising from your violation of these terms or the law.
Website. We are not responsible for website downtime, browser compatibility, internet outages or errors that prevent you from using the site.
Governing law. These terms are governed by the laws of the State of Missouri. Any dispute will be heard in the state or federal courts serving Warren County, Missouri.
